Fail to Stop / Report

When driving on the road you have certain legal obligations to other drivers and if you are involved in a road traffic accident. You are legally required to stop at the scene of the accident and exchange your details with other parties involved. If for whatever reason you do not do this, you commit the offence of failing to stop or report an accident. In addition, most people do not know that any accident must be reported the police within 24 hours of the accident so it can be documented. This is an offence under Section 170 of the Road Traffic Act 1988.

What are the penalties? Fail to Stop

Failing to report or stop at the scene of an accident is a serious offence, and you may face:

  • Being arrested
  • A maximum fine of £5,000
  • Between 5 and 10 penalty points on your driving licence
  • As a new driver you may have your licence revoked if you obtain 6 or more penalty points within your first two years of driving. You will also need to retake your driving test
  • Will face a driving ban for a minimum of 6 months if you obtain 12 or more points on your licence as a result of totting up
  • You may face a prison sentence

The penalties for both offence are steep and this is to stop people from leaving the scene of an accident. Furthermore  if they are drunk and avoiding the harsher penalties for drink driving. A judge will decide the level of your punishment. However  if you injured someone seriously as fled the scene and did not report the accident. You will almost certainly be given a tougher punishment so speak with our Motoring Defence Team.
