Represented client who faced multiple counts of anal and vaginal rape’s in a domestic context in breach of a non-molestation order whilst victim was both awake and asleep. Further counts of assault against the same victim were also alleged. We were able to identify evidence which we used to successfully challenge the credibility of the victim in this case and therefore persuade the prosecution not to proceed with the allegations of Rape and Assault against the defendant. The defendant accepted being in breach of the non-molestation order on the basis the complainant consented to it given telephone evidence from the defendant’s phone confirmed contact had taken place and was dealt with by time served.
